The U.S. Environmental Protection Agency (EPA) has recently issued an interim final rule extending the PFAS reporting period to allow additional time for developing and testing its data collection system. The extension is intended to improve system functionality and inform EPA of any needed guidance for reporting entities.
Under section 8(a)(7) of the Toxic Substances Control Act (TSCA), EPA finalized a rule in October 2023 requiring manufacturers and importers of PFAS between 2011 and 2022 to report detailed information on uses, byproducts, worker exposure, and environmental and health effects.
Key changes:
- Submission start date moved from July 11, 2025, to April 13, 2026
- Deadline extended to October 13, 2026, for most manufacturers
- Small manufacturers importing only articles have until April 13, 2027
The delay is effective immediately. EPA will accept public comments on the reporting period extension for 30 days. The agency is also considering reopening other parts of the rule for further public input.
